1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the website, services, and software solutions provided by Tecnowelt (“Company,” “we,” or “us”). By accessing our website or engaging our development services, you agree to be bound by these Terms.
2. Scope of Engineering & SEO Services
Tecnowelt delivers custom web application development, UI/UX design, technical SEO optimization, and infrastructure maintenance. Specific project scopes, deliverables, timelines, and payment terms are detailed in formal Statements of Work (SOW) executed between Tecnowelt and the client.
3. Intellectual Property Rights
Unless explicitly stated otherwise in a custom SOW:
- Client Deliverables: Upon full payment of all invoice balances, all custom code, graphic assets, and unique designs created specifically for the client transfer to full client ownership.
- Company Pre-Existing IP: Tecnowelt retains all rights to pre-existing framework modules, reusable libraries, internal development tools, and proprietary methodologies utilized during development.
4. Client Responsibilities
Clients agree to provide timely access to necessary accounts, media assets, API credentials, and feedback required for project completion. Delays in providing necessary materials may extend agreed-upon delivery milestones.
5. Payment Terms & Invoicing
Services are billed according to the payment schedule specified in the project agreement. Invoices are due upon receipt or according to agreed SLA terms. Overdue payments may result in a temporary pause on active development sprints.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Tecnowelt shall not be liable for any indirect, incidental, consequential, or special damages resulting from service interruptions, third-party hosting outages, or search engine algorithm modifications beyond our direct control.
7. Warranties & Guarantees
We warrant that all custom code delivered by Tecnowelt will be free of critical defects for a 60-day warranty period post-launch. While we apply industry-best technical SEO practices, we do not guarantee specific numerical search rank placements due to unpredictable search engine core algorithm changes.
8. Governing Law
These Terms shall be governed by and construed in accordance with the applicable commercial laws. Any disputes arising from these Terms shall be submitted to binding arbitration in accordance with local regulations.
